Pretrial

You may plead not guilty by mail, fax, email, or in person, prior to your Court date. The letter must state your plea, the citation number, court date, and a current address with phone number and email address.

After you plead not guilty, you will be scheduled for a pretrial conference with the Village Attorney.  At the conference, you and the Village Attorney will discuss your case. If an agreement is reached, a written Pretrial Stipulation will be submitted. The Judge will review the stipulation and either approve or reject it. If no agreement can be reached, the case will be scheduled for trial.

Trial

All trials, except non-traffic ordinance juvenile cases, are public trials. You have the right to retain your own attorney and to subpoena witnesses. You are presumed innocent and will be convicted only if the evidence is clear, convincing, and satisfactory that you committed the violation with which you have been charged. All witnesses must testify in person and under oath. There are no jury trials in Municipal Court.
